Welcome to ChikanVeda (“ChikanVeda”, “we”, “us”, “our”). These Terms & Conditions (“Terms”) govern your access to and use of www.chikanveda.com and your purchase of products offered through the website.

By accessing, browsing, registering on, or purchasing from the Website, you acknowledge that you have read, understood and agreed to these Terms and the policies referred to herein.

1. Eligibility

You must have the legal capacity to enter into a binding contract under applicable Indian law to place an order on the Website.

If you are below the age permitted to independently enter into contracts under applicable law, you may use the Website only with the involvement and supervision of your parent or legal guardian.

2. Acceptance of Terms

Your use of the Website and placement of an order constitutes your acceptance of these Terms.

If you do not agree with these Terms, please do not use the Website or place an order.

3. Products and Product Information

ChikanVeda makes reasonable efforts to ensure that product descriptions, photographs, colours, sizes, materials and other product information displayed on the Website are accurate.

However:

1. actual colours may vary slightly depending on your device display and screen settings;

2. handmade, hand-embroidered or artisan-crafted products may contain minor variations in embroidery, texture, thread placement, weave, colour or finish;

3. such reasonable variations shall not ordinarily constitute a manufacturing defect;

4. product measurements may have reasonable manufacturing/tailoring tolerances;

5. product availability is subject to stock availability.

Where a product is represented as handmade or handcrafted, reasonable handmade variations shall be considered part of the character of the product.

4. Prices and Taxes

Product prices shall be displayed on the Website in Indian Rupees unless otherwise stated.

Applicable taxes, including GST wherever applicable, shall be charged in accordance with applicable law.

Where applicable, delivery, shipping or other charges shall be separately disclosed before completion of the purchase.

ChikanVeda reserves the right to correct genuine pricing, typographical, technical or display errors. If an order has been placed at an obviously erroneous price, ChikanVeda may contact the customer and provide the option to reconfirm or cancel the order.

5. Product Availability

Adding an item to your cart does not guarantee availability.

An order is subject to acceptance and availability of the product.

If a product becomes unavailable after an order is placed, ChikanVeda shall inform the customer and, where payment has already been made, process an applicable refund in accordance with the Refund Policy.

6. Account and Customer Information

Where account creation is available, you are responsible for maintaining the confidentiality of your login credentials and for activities conducted through your account.

You agree to provide accurate, complete and current information.

ChikanVeda may refuse, suspend or cancel an account or transaction where there is reasonable evidence of fraud, abuse, unlawful activity or misuse of the Website.

7. Orders

When you place an order, you are making an offer to purchase the selected products.

An order acknowledgement may be sent after order placement. Such acknowledgement does not necessarily constitute final acceptance of the order.

ChikanVeda may accept or decline an order in whole or in part due to reasons including:

• product unavailability;

• pricing or listing errors;

• suspected fraudulent transactions;

• inaccurate customer information;

• delivery restrictions;

• technical or payment failures;

• circumstances beyond reasonable control.

If an order is cancelled by ChikanVeda after payment has been received, the applicable amount shall be refunded through the original or legally/operationally appropriate payment method.

8. Payment

Available payment methods may include prepaid online payment and Cash on Delivery (“COD”), subject to availability.

Online payments may be processed through third-party payment service providers.

ChikanVeda does not ordinarily store complete card details such as CVV or card PIN.

Customers must use only payment methods lawfully belonging to them or which they are authorised to use.

9. Cash on Delivery

COD availability may depend on:

• delivery location;

• order value;

• courier serviceability;

• product category;

• customer/order history;

• fraud and risk controls.

10. Cancellation

Customers may request cancellation in accordance with the Cancellation Policy.

Where cancellation is legally or operationally permitted, ChikanVeda shall process the cancellation in accordance with the applicable policy.

No cancellation charge shall be imposed contrary to applicable law.

11. Returns, Exchanges and Refunds

Returns, exchanges and refunds are subject to the separate:

• Return Policy;

• Exchange Policy; and

• Refund Policy.

Nothing in these Terms is intended to exclude or restrict any mandatory consumer right available under applicable law.

12. Shipping and Delivery

Orders shall be shipped to serviceable locations supported by ChikanVeda and its logistics partners.

Estimated delivery timelines are indicative unless a specific delivery commitment is expressly provided.

Delivery may be affected by weather, natural disasters, strikes, public holidays, logistical disruptions, incorrect addresses, restricted locations, government restrictions or other circumstances beyond reasonable control.

13. Customer Inspection at Delivery

Customers should inspect the external package at the time of delivery wherever reasonably possible.

If the package appears materially damaged, tampered with or opened, the customer should, where possible, record video evidence and promptly contact ChikanVeda.

Failure to inspect a package does not automatically extinguish statutory consumer rights.

14. Intellectual Property

Unless otherwise stated, all Website content, including:

• logos;

• brand name;

• product photographs;

• graphics;

• text;

• designs;

• layouts;

• product descriptions;

• videos;

• artwork;

• trademarks;

• trade dress;

is owned by ChikanVeda and is protected under applicable intellectual property laws.

You may not reproduce, copy, modify, distribute, commercially exploit or use ChikanVeda’s intellectual property without prior written permission.

15. User Content

If you submit reviews, photographs, testimonials or other content to ChikanVeda, you represent that you have the right to submit such content.

You grant ChikanVeda a non-exclusive, royalty-free licence to use such content for legitimate business, customer-service and marketing purposes, subject to applicable privacy and consent requirements.

ChikanVeda reserves the right to remove content that is unlawful, abusive, defamatory, misleading, fraudulent, obscene, infringing or otherwise inappropriate.

16. Prohibited Activities

You must not:

• use the Website for unlawful purposes;

• attempt unauthorised access to Website systems;

• introduce malware or malicious code;

• interfere with Website security;

• use bots or automated systems to abuse the Website;

• create fraudulent orders;

• misuse promotional offers;

• undertake payment fraud or chargeback abuse.

17. Promotions and Discounts

Unless expressly stated otherwise:

• offers cannot be combined;

• promotional benefits cannot be exchanged for cash;

22. Force Majeure

ChikanVeda shall not be responsible for delay or failure caused by events beyond reasonable control, including natural disasters, fire, flood, epidemic/pandemic, war, civil disturbance, strikes, governmental restrictions, major technological failures, transportation disruptions or similar events.

23. Consumer Rights

Nothing in these Terms shall be interpreted as taking away or restricting rights available to consumers under mandatory applicable Indian law.

24. Governing Law

These Terms shall be governed by the laws of India.

Subject to applicable consumer-protection laws and jurisdictional rules, disputes may be subject to the jurisdiction of competent courts/authorities in India.

Nothing herein prevents a consumer from exercising a statutory right to approach an appropriate Consumer Commission or other competent authority.
